Alleged Attacker Makes Bail

A week after a court magistrate described him as a danger to the community, Brandon Rosa has been released from jail as he awaits court action in a recent assault case.

In April, Rosa was arrested for allegedly attacking a local high school student in a fit of road rage. As the Dutch Harbor Telegraph initially reported, Rosa allegedly became violent with Killian Baker after Baker passed him while driving and gave him a “funny look.”  Baker was medevaced to Anchorage as a result of the beating, and Rosa was charged with assault in the second degree – a felony.

Rosa was released from police custody yesterday. He was already out on bail for a previous assault involving a different high school student, but this time, the terms are stricter. The court set bail at $2,000, and Rosa must have a third-party custodian with him at all times. According to Assistant District Attorney Katie Summers, Rosa may also be charged with the crime of violating his release conditions, a misdemeanor that’s punishable with a year in prison and a $10,000 fine.

Rosa’s next court date is set for May 18.

The courts are set up to protect the community as well as protect the rights of the accused. The accused whine and cry and get deference. The community as a whole says nothing, so the courts don't have to toe the mark. Until the community members start letting the courts know that this type of thing will not be tolerated, they will continue to set these predators free.

I am disappointed! I have two sons that I worry about being the next victims! I worry about everyone in this community with him out of jail. I can't believe he got out free after the first assault! This is really too bad and I hope he does go to prison!

Realy, out on bail? Already out on bail for beating up another high school kid? I thought the courts were supposed to help ensure the safety of the community? I understand innocent until proven guilty, but there has to be some deference paid to protecting the community...
