Unalaska, AK – A California man who was charged with murder following a fatal van accident in Unalaska in September has been found guilty and sentenced to 12 1/2 years in jail.
Forty-seven-year-old Victorio Cabrera, who was working for UniSea at the time of the incident, was found guilty of second degree murder, first degree assault and DUI last month, according to court documents received by the Unalaska courthouse last week. Two lesser charges were dropped.
On the night of September 15, Cabrera was driving three other UniSea plant employees from the Sports Bar to the Unalaska side of town when a public safety officer saw him speeding and swerving along Airport Beach Road. After the officer turned on his lights, Cabrera sped up to 80 miles per hour, then crashed through the guardrail alongside the South Channel Bridge.
The van plunged down the embankment and rolled over. Cabrera and the front seat passenger were able to climb out of the van. A third passenger, Alan Fulinara, was pronounced dead later that night. A fourth man, Nelwin Duran, had his leg broken in the accident and was flown to Anchorage for treatment.
Cabrera received the minimum sentence of 10 years for the murder charge and another two and a half years for the assault charge. A third-degree assault charge that was filed at the same time was dropped, as was a later hit-and-run charge. He is eligible for parole.
