Man Faces Charges for Allegedly Kicking Police Officer

A 25-year old-man is facing charges for allegedly assaulting an Unalaska police officer.  

According to court documents, an officer found an unconscious man in the parking lot of the Dutch Harbor Mall around 1 in the morning on August 25. The man, who was identified as Mark Evangelista, was unresponsive and smelled of alcohol.

The officer called an ambulance and brought Evangelista to the clinic. He regained consciousness and was medically cleared to go to jail. As two police officers prepared to help Evangelista up, the man kicked Sgt. Roger Bacon in the groin.  

Evangelista was arrested and charged with 4th degree assault on a law enforcement officer. He posted $500 in bail, and is scheduled to appear in court on October 29.

Yeah, cuz being passed out drunk in a parking lot is perfectly acceptable. If I thought that the town I lived in didn't have a law against that, I would move away immediately.

My guess would be a charge of drunk in public, probably difficult to give him a parking ticket if he was laying in the parking lot........just sayin

What was charge before the alleged kick? on Monday, September 16 2013:

WTF - someone passed out and you take them to the clinic to revive them so you can arrest them - for what? Give him a parking ticket like they do my truck for parking overnight at the upscale mostly unused Dutch Harbor Mall parking lot - but arrest him for What??? If he was medically cleared - why did he need help getting up? There is more to this story - but obviously the reporter was not given a reason for the arrest before the alleged Kick - as there was none.
